Modern Slavery Act

Introduction 

“PE” is the brand name for the following legal entities that provide business solutions to businesses in the United Kingdom. The Modern Slavery Statement is published on the customer’s UK website. The board of directors have approved the Modern Slavery Statement. 

This Modern Slavery Policy applies to each legal entity using the brand name of “PE” and includes: 

  • Pozitive Energy Ltd (company registration number 09523048) 
  • Pozitive Water Limited (company registration number 10797006) 
  • Pozitive Payments Ltd (company registration number 12300457) 
  • Pozitive Telecom Ltd (company registration number 07764492) 
  • PE Dot Solutions Ltd (company registration number 15569520) 

 

Human trafficking definition 
Forced work, through mental or physical threat, being owned or controlled by an employer through mental or physical abuse, the danger of abuse, being dehumanised, treated as a commodity or being bought or sold as property, being physically constrained or having restrictions placed on freedom of movement. 

Commitment 
PE acknowledges its responsibilities in relation to tackling modern slavery and commits to complying with the provisions in the Modern Slavery Act 2015. PE understands that this requires an ongoing review of both its internal labour practices and its supply chains. 

PE does not enter into business with any other organisations, in the United Kingdom or abroad, which knowingly support or are found to involve themselves in slavery, servitude and forced or compulsory labour. 

No labour provided to PE in the pursuance of the provision of its own services is obtained by means of slavery or human trafficking. PE strictly adheres to the minimum standards required under relevant employment legislation in the UK and India, and in many cases exceeds those legal obligations. 

Supply chains 
To fulfil its activities, the PE’s leading supply chains, in addition to the business’s employees in the UK and India described above, include energy generators, wholesalers, energy brokers, and meter operators. 

Potential exposure 
In general, PE considers its exposure to slavery/human trafficking to be limited. Nonetheless, it has taken steps to ensure that such practices do not take place in its business and is currently reviewing the policies of its outsourced partners as well. 

Steps 
PE carries out due diligence processes in relation to ensuring slavery and/or human trafficking does not take place in its organisation or supply chains, including conducting a review of the controls of its suppliers. 

PE has not, to its knowledge, conducted any business with another organisation which has been found to have involved itself with modern slavery. 

In accordance with section 54(4) of the Modern Slavery Act 2015, PE is currently taking the following steps to ensure that modern slavery is not taking place: 

  • Reviewing supplier contracts to include termination powers if the supplier is, or is suspected, of being involved in modern slavery 
    putting measures in place to identify and assess the potential risks in its supply chains. 
  • Undertaking impact assessments of PE’s services upon potential instances of slavery. 
  • Creating action plans to address risk to modern slavery. 

We are training and briefing our staff on modern slavery to ensure a zero-tolerance approach in all areas of the business. 

Key performance indicators 
PE has set the following key performance indicators to measure its effectiveness in ensuring modern slavery is not taking place in the organisation or its supply chains: 

  • Ensure that all our staff are trained and informed and are aware of the company’s policy in terms of modern slavery. 
  • Thorough due diligence throughout our supply chain to ensure our Business does not contract with businesses that practice or are suspected of practising modern slavery. 
  • Constant review of our business activities via risk assessment to minimise the risk of modern slavery. 
  • Engender a culture which encourages staff and stakeholders to speak out if they see anything untoward in respect of modern slavery. 

 

Policies 

PE continually reviews its policies and procedures to ensure compliance with the Modern Slavery Act 2015.  The Modern Slavery Statement is updated annually (within 6 months of the organisation’s financial year-end). The director signs off the Modern Slavery Statement.
